Terms of Service

1. Important notice — InvestIQ is not investment advice

InvestIQ is an informational and educational financial-analysis tool. It is NOT a licensed investment firm, investment adviser, financial adviser, broker, or portfolio manager, and it does NOT provide investment advice, personal recommendations, or any service regulated under MiFID II, by the Autorité des marchés financiers (AMF) or by any equivalent authority.

The scores, signals (such as "BUY", "HOLD", "SELL"), narratives, audits, briefs and assistant responses produced by the Service are generic, automated outputs based on third-party data and statistical models. They are provided for information only, do not take account of your personal circumstances, objectives or risk tolerance, and must not be relied upon as a recommendation to buy, sell or hold any financial instrument.

You are solely responsible for your investment decisions. Investing involves risk, including the possible loss of your capital. Past performance is not a reliable indicator of future results. Before making any decision, you should carry out your own research and, where appropriate, consult a duly authorised professional adviser. By using the Service you acknowledge and accept this notice.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate and kept up to date.

The Service is intended for retail users acting in a personal capacity. It is not directed at, and may not be used by, any person in a jurisdiction where the Service would be unlawful.

3. The Service

The Service lets you analyse listed securities and ETFs, audit and track portfolios, build watchlists, interact with an AI assistant, and receive briefs and alerts. Features depend on your plan and may change, be added or removed over time.

Market data, fundamentals, news and similar information are provided by third parties (including Financial Modeling Prep). They may be delayed, incomplete or inaccurate, and we do not guarantee their accuracy, completeness or timeliness.

4. AI-generated content

Parts of the Service use third-party large-language-model providers (including Anthropic and OpenAI) to generate narratives, comparisons and assistant replies. AI output can be inaccurate, incomplete or misleading ("hallucinations") and must be treated as informational only, never as advice or as a statement of fact.

Deterministic scores are computed by our own engine from third-party data; the AI layer only interprets and phrases those scores. You remain responsible for verifying any information before acting on it.

5. Your account

You must register for an account to use most features. You are responsible for keeping your credentials confidential and for all activity under your account. You agree to notify us promptly of any unauthorised use. We may refuse, suspend or terminate accounts that breach these Terms.

6. Plans, billing and cancellation

The Service offers a free tier and paid subscriptions (currently "Pro" and "Ultra"), billed monthly or annually. Current prices and plan contents are shown on the Pricing page and may change for future billing periods, with prior notice.

Payments are processed by our payment provider, Stripe. We do not store your full card details. By subscribing you authorise recurring charges to your payment method.

Paid plans are charged at the start of each billing period; the first charge is taken when you subscribe. Subscriptions renew automatically for successive periods until cancelled.

You can cancel at any time from your account settings or via the customer portal; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, fees already paid are non-refundable and we do not provide partial-period refunds.

7. Right of withdrawal (EU/EEA consumers)

If you are a consumer in the EU/EEA you normally have a 14-day right of withdrawal for distance contracts. Because the Service is digital content/services supplied immediately, you expressly request that performance begin during the withdrawal period and acknowledge that you lose your right of withdrawal once performance has begun (and, for digital content, once download/streaming/access starts).

Nothing in these Terms removes mandatory consumer-protection rights you have under the laws of your country of residence.

8. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in breach of these Terms;
• scrape, harvest, bulk-download, resell or redistribute data or outputs except as expressly permitted;
• circumvent rate limits, quotas, credit limits or access controls, or use bots/automation beyond any API we provide;
• reverse-engineer, decompile or attempt to extract the source code, scoring methodology or models, except to the extent this restriction is prohibited by law;
• upload malicious code, attempt to gain unauthorised access, or disrupt the integrity or performance of the Service;
• misrepresent the outputs as personalised advice, or present them to third parties as a regulated recommendation.

We may rate-limit, suspend or terminate access for conduct that we reasonably believe breaches this section.

9. Intellectual property

The Service, including its software, scoring engine, methodology, design, text, and branding (the "InvestIQ" name and logo), is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own internal, non-commercial purposes in accordance with these Terms. No other rights are granted.

10. Your content and data

You retain ownership of the data you submit (such as portfolio positions, watchlists and messages). You grant us a worldwide, non-exclusive licence to host, process and display that data solely to operate and improve the Service and to provide it to you, in accordance with our Privacy Policy. You are responsible for ensuring you have the right to submit any data you provide.

11. Availability — "as is"

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or that outputs will be accurate or profitable.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profits, trading or investment losses, lost opportunities, or loss of data, arising out of or relating to your use of (or inability to use) the Service or any reliance on its outputs.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) cap amount, e.g. EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, fraud, or mandatory consumer rights).

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages and reasonable costs arising from your breach of these Terms, your misuse of the Service, or your infringement of any third-party right.

14. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, the licences granted to you end; sections that by their nature should survive (including disclaimers, IP, liability and governing law) continue to apply.

15. Changes to the Terms or the Service

We may update these Terms from time to time. If a change is material we will take reasonable steps to notify you (for example by email or an in-app notice) before it takes effect. Continued use after the effective date constitutes acceptance. We may also modify, suspend or discontinue parts of the Service.

16. Governing law and disputes

These Terms are governed by French law, without prejudice to the mandatory consumer-protection rules of your country of residence. Disputes will be subject to the jurisdiction of the competent courts of competent court — e.g. Paris, subject to mandatory consumer rules.

EU consumers may use the European Commission Online Dispute Resolution platform at ec.europa.eu/consumers/odr, and may have access to a consumer mediator: name/contact of the consumer mediator — required for French B2C e-commerce.

17. Miscellaneous

If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or sale. These Terms, together with the Privacy Policy and any plan-specific terms, are the entire agreement between you and us regarding the Service.
